Terms of service

The boundaries around everything else this site promises. Short, and in the same plain English as the rest of it, because terms nobody reads protect nobody.

Who these cover

These terms apply to using this website, to requesting a free store check, and to any work we do for you unless we have signed something separate with you that says otherwise. If we have, that document wins.

The free store check

It is genuinely free and there is no obligation attached to it. You do not need to give us access to anything, and we do not need to speak to you. We look at your storefront the same way a customer or a search engine would.

What you get is our opinion, in writing, about what appears to be costing you orders. It is not an audit in any formal or professional sense, it is not advice about your business, and it is based only on what is publicly visible. The findings are yours to keep and to give to anyone, including another supplier.

We may decline to do one, for example if the store is not on Shopify, if there is nothing useful to say, or if we are simply at capacity. We will tell you rather than leave you waiting.

What we do, and what we do not

We look after Shopify storefronts: catalogue and product data, findability, fixing what breaks, email and SMS flows, and development work on the theme and integrations. The services pages describe this in detail.

Outside what we take on, and referred out rather than guessed at:

  • accounting and bookkeeping
  • legal and trademark work
  • managing your advertising budget
  • anything requiring someone physically present

We will also not pass off machine-translated product copy as a finished translation, and we do not recommend an app or service that pays us anything. We hold no affiliate or referral arrangements with the tools we suggest.

What we do not promise

This is the part worth reading twice, and it is here because the rest of the site talks about results.

We do not guarantee outcomes. Not a level of sales, not traffic, not a search ranking, not a position in Google Shopping, not a conversion rate. Nobody honestly can: those depend on your product, your prices, your market, your competitors, and on platforms whose rules change without notice and are not ours. What we commit to is doing the work competently and telling you what we did.

Timings on this site are typical, not contractual. Where we say a person replies within one business day, or that onboarding takes about two weeks, those are what normally happens and what we aim for. They are not a service level with a remedy attached. If you need a committed response time, we will agree one with you in writing and it will say what happens if we miss it.

Nothing here is a refund entitlement. If we get something wrong we will fix it, and if we have charged you for something we did not do we will return it. Beyond that, refunds are a conversation rather than a right, and month-to-month billing exists so that stopping is the straightforward remedy.

Third-party platforms are not within our control. Shopify, Google, Meta, Klaviyo, app vendors and payment providers change their products, pricing and policies on their own schedule. We are not responsible for their outages, their decisions, or their fees.

Access, and what we do with it

Where work needs access to your store, you grant it through Shopify's own staff or collaborator system, in your name, and you can revoke it yourself at any time without asking us. We will not ask you to share your password, and you should not offer it.

We ask for the permissions the work needs and no more. Everything we do is inside your own admin, so it is visible to you in the store's activity log while it happens rather than afterwards.

Your store, your content, your data and your customer relationships remain entirely yours. We claim nothing over them, we do not hold them hostage, and if we stop working together we do not take anything with us or leave anything locked.

What we need from you

Access when the work requires it, answers to questions that block progress, and the authority to make the changes you are asking for. If the products, prices or claims on your store need to comply with something specific to your industry, that knowledge has to come from you, because we will not know it.

You are responsible for what you sell and for what your store says about it. If you ask us to publish something that is untrue or unlawful, we will decline.

Prices, billing and tax

Prices are listed on the pricing page and are quoted in US dollars. Canadian invoicing is available; ask and we will arrange it. Prices exclude any applicable taxes, which are added where required.

Monthly plans are billed monthly in advance. Fixed-fee work is quoted before it starts and the quote is what you pay unless the scope changes, in which case we agree the change with you first rather than surprising you on an invoice. Hourly work is billed against time actually worked.

If we increase a monthly price we will give you at least thirty days' notice, and you can cancel instead. We will not raise the price of work already agreed.

Stopping

There is no minimum term on monthly plans and no cancellation fee. Tell us and we will stop at the end of the period you have paid for. We ask for the same courtesy in reverse: if we cannot continue we will tell you rather than going quiet, and we will hand over cleanly.

Either of us can end the arrangement immediately if the other seriously breaches these terms. You can revoke our access at any moment, for any reason, without notice.

Confidentiality

We keep what we learn about your business to ourselves. We will not name you as a client or describe your store publicly without asking you first.

Who owns the work

Work we produce specifically for you — theme changes, product copy, email templates, configuration — is yours once it is paid for. We keep ownership of our own general methods, checklists and internal tooling, which are not specific to you, and nothing stops us using the same approaches for someone else.

Content on this website, including the guides and the free tools, is ours. You are welcome to read it, use it, and act on it yourself; please do not republish it as your own.

Limits on liability

We will do the work with reasonable skill and care. We are not liable for indirect or consequential losses, including lost profit, lost sales or lost data, and our total liability for any claim is limited to the amount you have paid us for the work in question in the three months before the claim arose.

Nothing in these terms limits liability that cannot lawfully be limited, and none of it removes rights you have under consumer protection legislation that applies to you.

Which law applies

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and the courts of Ontario have jurisdiction. If you are a consumer in another province or country with laws that give you rights you cannot contract out of, this clause does not take them away.

Changes

If these terms change, the date at the top changes. Changes apply going forward, not retroactively to work already done or already agreed.
